    Hello everybody. My client was caught DUI. He is on a work permit under CUAET that we have to extend. Here is the summary from him:

    On June 04, 2024 I have been charged with :

    Count 1. operate a conveyance while his ability to operate it was impaired to any degree by alcohol, or a drug, or both, contrary to Section 320.14(1)(a) of the Criminal Code.

    Count 2. within two hours after ceasing to operate a conveyance, have a blood alcohol concentration that was equal to or exceeded 80 milligrams of alcohol in 100 milliliters of blood, contrary to Section 320.14(1)(b) of the Criminal Code.

    November 20, 2024 pleaded guilty to Count 2.
    Date of conviction: 20-Nov-2024

    Count 1 was withdrawn.

    Disposition: $2000 fine and 1 year driving prohibition from 20-Nov-2024 to 20-Nov 2025.
    I have already completed the course, paid the fine and got the D reinstated.

    My Question: do I just apply to extend the OWP and supply the info, or do I HAVE TO go the TRP and rehab route right away?

    I assume the offence occurred in Canada. There is no option for rehab for in-Canada applications. Also, record suspension is only available after five years. This person is inadmissible on Serious Criminality and not even protected by ADR for Ukrainians. This is a complicated case, and I don’t want to offer an answer without consultation.
